Privacy Policy

VeriSend Technologies LLC ("VeriSend," "we," "us," or "our") operates as a transactional email infrastructure provider. This Privacy Policy describes how we collect, use, store, and protect information in connection with our services and our website located at verisend.us. By using our services, you agree to the practices described in this policy.

1. Information We Collect

Account and Registration Information

When you create an account or request access to VeriSend services, we collect your name, business email address, company name, website URL, phone number, billing information, and information about your intended use of the platform.

Technical and Usage Data

We automatically collect server logs, IP addresses, API request metadata, sending statistics, delivery and bounce events, and browser/device information when you use our web interface. This data is used to operate the service, diagnose issues, and enforce our Acceptable Use Policy.

Email Metadata (Not Content)

When your application sends transactional emails through VeriSend, we collect metadata including sender address, recipient address, subject line, message size, timestamp, delivery status, and bounce or complaint events. We do not permanently store the full body content of messages beyond what is required for temporary delivery queuing (see Section 3).

Customer Support Communications

If you contact our support or sales team, we retain those communications to assist you and to improve our services.

2. How We Use Your Information

We use collected information to: provide, operate, and maintain the VeriSend platform; authenticate users and secure accounts; deliver transactional messages on your behalf; generate delivery reports and analytics for your dashboard; detect and prevent abuse, spam, and policy violations; communicate with you regarding your account, billing, and service updates; comply with legal obligations; and improve our services.

We do not use your data to send you marketing emails without your consent, and we do not sell, rent, or trade personal information to third parties for their marketing purposes.

3. Email Processing

VeriSend processes email on behalf of our customers as a data processor. Our customers (businesses using the VeriSend API or SMTP relay) are the data controllers for the personal data of their email recipients. Message bodies are temporarily retained in delivery queues for a maximum of 72 hours before being purged. Delivery metadata (sender, recipient, timestamps, status) is retained for up to 30 days in the customer dashboard and up to 90 days in our internal logs for abuse investigation purposes.

Important: VeriSend customers are responsible for ensuring they have appropriate legal basis (such as explicit opt-in consent) for sending transactional emails to their recipients. VeriSend does not independently verify recipient consent but enforces opt-in requirements at the account policy level.

4. Data Sharing

We do not sell personal data. We may share information with: (a) service providers who assist in operating our infrastructure (such as cloud hosting, monitoring, and payment processing vendors) under appropriate data processing agreements; (b) law enforcement or government agencies when required by law or to protect the rights and safety of VeriSend, our customers, or the public; (c) a successor entity in the event of a merger, acquisition, or sale of VeriSend assets, provided the successor agrees to the terms of this policy.

5. GDPR Compliance

VeriSend operates in compliance with the EU General Data Protection Regulation (GDPR) where applicable. As a data processor acting on behalf of our customers (data controllers), we will: process personal data only on documented instructions from the controller; maintain appropriate technical and organizational security measures; assist controllers in fulfilling data subject rights requests; delete or return personal data upon the end of the service relationship; and maintain records of processing activities.

For customers processing personal data of EU residents, VeriSend is prepared to execute a Data Processing Agreement (DPA). Please contact privacy@verisend.us to request a DPA.

Legal bases for our own processing of customer data include: (a) contract performance (operating the service you have contracted); (b) legitimate interests (fraud prevention, abuse detection, service improvement); (c) legal obligation (compliance with applicable law); and (d) consent where obtained.

6. CAN-SPAM Compliance

VeriSend operates in full compliance with the CAN-SPAM Act of 2003. Our platform is designed exclusively for transactional and relationship messages as defined under CAN-SPAM. All accounts are required to maintain functional unsubscribe mechanisms for any messages that could be considered commercial in nature, to include accurate sender identification in all messages, and to process opt-out requests within 10 business days. VeriSend's Anti-Spam Policy strictly prohibits deceptive header information, misleading subject lines, and messages to recipients who have opted out.

7. Data Retention

We retain account data for the duration of your service relationship with VeriSend and for up to 36 months thereafter for legal and audit purposes. Email delivery metadata is retained for 90 days in operational systems. Billing records are retained for 7 years as required by US tax law. You may request early deletion of personal data subject to our legal retention obligations by contacting privacy@verisend.us.

8. Your Rights

Depending on your jurisdiction, you may have rights to: access personal data we hold about you; correct inaccurate data; request deletion of your data; restrict or object to certain processing; data portability; and lodge a complaint with a supervisory authority (EU residents). To exercise any of these rights, contact privacy@verisend.us. We will respond within 30 days.

9. Security

VeriSend employs industry-standard technical and organizational measures to protect your data, including TLS encryption for all data in transit, encryption at rest for sensitive account data, access controls and multi-factor authentication for internal systems, and regular security reviews. No method of transmission over the Internet is 100% secure. In the event of a data breach affecting your personal data, we will notify affected parties as required by applicable law.

10. Children's Privacy

VeriSend's services are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected such data, please contact us immediately at privacy@verisend.us.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify registered customers of material changes via email at least 14 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised policy. The most current version is always available at verisend.us.

1. Acceptance of Terms

By accessing or using VeriSend Technologies LLC's services ("Services"), you ("Customer" or "User") agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree to these Terms, you may not use the Services.

2. Description of Services

VeriSend provides transactional email delivery infrastructure including SMTP relay, a RESTful API, IP address management, email authentication tools (DKIM, SPF, DMARC), delivery reporting, and related technical services. VeriSend's services are exclusively intended for transactional email—defined as emails triggered by a specific action or request by the recipient, including but not limited to: order confirmations, shipping notifications, password resets, account verification emails, security alerts, and usage notifications.

5. Anti-Spam Policy

VeriSend has a zero-tolerance policy for spam. This means that we do not allow, at any time or for any reason, the sending of unsolicited commercial or bulk email through our infrastructure. Any account found to be sending spam will be suspended immediately, without notice. VeriSend cooperates fully with law enforcement and ISP postmasters investigating spam originating from compromised or abusive accounts. For full details, see our Anti-Spam Policy at verisend.us.

6. Opt-In Requirement

VeriSend requires that all email recipients have provided explicit, informed consent to receive communications from you. This means recipients must have affirmatively subscribed or opted in to your email communications—pre-checked boxes, implied consent, and inferred interest do not qualify as explicit opt-in under our policy. We strongly recommend implementing double opt-in (confirmed opt-in) to maximize list hygiene and reduce complaint rates. Use of any list not built through voluntary opt-in subscriptions is strictly prohibited and constitutes grounds for immediate termination of service.

7. Account Suspension & Termination

VeriSend reserves the right to suspend or terminate any account, with or without notice, for any violation of these Terms or the Acceptable Use Policy. Grounds for immediate suspension without notice include: spam complaints exceeding 0.08% complaint rate, use of non-opt-in lists, sending deceptive or phishing messages, evidence of account compromise, or any activity that endangers the deliverability reputation of VeriSend's infrastructure.

For violations that do not pose immediate risk, VeriSend will issue a written warning and provide 48 hours to remediate the issue before suspension. Upon termination, all account data will be retained for 30 days during which you may export your data, after which it will be purged.

VeriSend does not issue refunds for accounts suspended due to policy violations.

8. Fees and Payment

Fees are charged in advance on a monthly basis. Overages are billed at the end of each billing cycle. All fees are non-refundable except as required by applicable law. VeriSend reserves the right to modify pricing upon 30 days' written notice to current customers.

9. Intellectual Property

VeriSend retains all rights to its platform, software, documentation, and brand assets. Customers retain ownership of their message content and domain configurations. Nothing in these Terms transfers any intellectual property rights from either party.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. VERISEND DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, NOR DOES VERISEND MAKE ANY WARRANTY REGARDING THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES. VERISEND SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VERISEND TECHNOLOGIES LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. VERISEND'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO VERISEND IN THE THREE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless VeriSend Technologies LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party, including any email recipients.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware, and both parties consent to the personal jurisdiction of such courts.

14. Changes to Terms

VeriSend reserves the right to modify these Terms at any time. Material changes will be communicated via email to registered account holders at least 14 days prior to the effective date. Continued use of the Services after the effective date of any modification constitutes acceptance of the updated Terms.

Anti-Spam Policy

Zero Tolerance: VeriSend maintains an absolute zero-tolerance policy for spam. Any account found to be sending unsolicited email will be immediately terminated. There are no exceptions to this policy.

Our Commitment

VeriSend Technologies LLC is an infrastructure provider for transactional email only. We are deeply committed to the health and integrity of the global email ecosystem. Spam is not merely a policy violation—it is an activity that harms email recipients, damages ISP relationships, and degrades email as a communication medium. We take this seriously, and we expect every customer on our platform to do the same.

1. Strict Opt-In Requirement

Every person who receives an email sent through VeriSend's infrastructure must have explicitly consented to receive that communication. "Explicit opt-in" means:

Implied consent, business card exchanges, conference attendee lists, LinkedIn connections, and similar practices do not qualify as explicit opt-in under our policy.

2. Double Opt-In: Strongly Recommended

VeriSend strongly recommends that all customers implement a double opt-in (also known as confirmed opt-in) process. In a double opt-in flow, after a user provides their email address, they receive a confirmation email and must click a verification link before they are added to the active list.

Double opt-in provides the highest quality list hygiene, reduces complaints, minimizes invalid addresses, and provides the strongest evidence of consent in the event of a dispute. Customers with high complaint rates may be required to implement double opt-in as a condition of continued service.

VeriSend employs automated and manual monitoring systems to detect sending patterns consistent with spam or policy abuse. These systems monitor:

Accounts triggering abuse detection thresholds are reviewed by our compliance team. Accounts with spam complaint rates above 0.08% will be placed under review. Rates above 0.10% will trigger automatic suspension pending investigation.

5. Immediate Termination for Violations

The following violations result in immediate account termination without prior notice or refund:

VeriSend reserves the right to report egregious violations to relevant authorities, ISP postmaster teams, and spam reporting organizations including Spamhaus, SURBL, and the FTC's CAN-SPAM enforcement division.

7. Customer Responsibility

Customers are solely responsible for the content, recipients, and legality of emails sent through VeriSend. By using the Services, you represent and warrant that all emails sent comply with applicable law (including CAN-SPAM, GDPR, CASL, and all other applicable anti-spam laws), that all recipients have explicitly opted in, and that your consent records are complete and auditable.
